Idaho HOA Rules for Board Members (2026)

New to a Idaho HOA or condo board? Before you send a violation letter or set a fine, it helps to know what the law actually says. Here are the Idaho rules in plain words, each with its statute section and a link to the official text.

Idaho homeowner's associations under the Homeowner's Association Act (Idaho Code §§55-3201 to 55-3213): associations whose governing documents let them assess and record liens. Before any fine: authority clearly in the covenants, written notice served at least 30 days before the board meeting where the vote is held, a majority board vote, and no fine while the owner is fixing the problem in good faith. Whether the Act covers condominium associations is unclear.

The short version:
  • Earliest board meeting for the fine vote (30 days after the notice was served): idaho Code §55-3206(1): written notice at least 30 days before the meeting at which the vote to impose the fine is held, by personal service or certified mail. Count from the date the notice was served; first day not counted. Holding the meeting later is fine.
  • Serve the fine-vote notice by (30 days before the meeting): idaho Code §55-3206(1): at least 30 days before the meeting at which the vote is held, by personal service or certified mail.
  • Political sign or protected flag only: earliest removal or penalty (3 days' written notice): idaho Code §§55-3209(4), 55-3210(4): no removal of a political sign or protected flag from a member's property, and no fine or penalty, without 3 days' written notice identifying the rule and the violation. If the third day is a Sunday or an Idaho holiday, wait until the next day (§73-109). Not for other violations. A fine still needs the 30-day notice and vote.

Which Idaho law applies

  • Idaho's Homeowner's Association Act (Idaho Code §§55-3201 to 55-3213) covers any incorporated or unincorporated residential association in which membership is based on owning or possessing an interest in real property and that has authority under its recorded covenants, bylaws or other governing documents to assess and record liens against members' property. An association without that lien authority is outside the Act's definition.

    Idaho Code §55-3203(7)(a)

  • No fine may be imposed for a violation of the covenants and restrictions unless the authority to fine is clearly set forth in the covenants and restrictions. A majority vote of the board is required before any fine. Written notice must be given to the member at least 30 days before the meeting at which the vote to impose the fine is to be held, served by personal service or certified mail.

    Idaho Code §55-3206(1)

  • If the member begins resolving the violation before that meeting, no fine may be imposed as long as the member continues to address the violation in good faith until it is fully resolved.

    Idaho Code §55-3206(2)

  • Whether the Act covers condominium associations is unclear: its definition has no condominium exclusion, so a condo association with lien authority likely falls under it alongside the Condominium Property Act, but no statute or court says so directly. Follow the Act's steps, and ask an Idaho attorney where the two laws differ.

    Idaho Code §55-3203(7)

How Idaho counts days

  • The time in which any act provided by law is to be done is computed by excluding the first day and including the last, unless the last is a holiday, and then it is also excluded.

    Idaho Code §73-109

  • Idaho's holidays are every Sunday, New Year's Day, Martin Luther King, Jr.-Idaho Human Rights Day (third Monday in January), Washington's Birthday (third Monday in February), Memorial Day, Independence Day, Labor Day, Columbus Day (second Monday in October), Veterans Day (November 11), Thanksgiving Day (fourth Thursday in November), Christmas, and any day appointed by the President or the Governor. A holiday on a Saturday is observed the Friday before; one on a Sunday, the Monday after.

    Idaho Code §73-108

Hearings in Idaho

  • Idaho's HOA Act sets no dollar cap on fines and no state cure period beyond the good-faith rule, and it doesn't require a separate hearing beyond the 30-day notice of the board meeting where the vote is held. Offering the owner a chance to speak is fair practice; your documents may add hearing or cure steps.

Idaho Code §55-3206 (no cap, cure period or hearing set)

Fines in Idaho

  • No part of any fine may be used to increase the pay of any board member or agent of the board. Attorney's fees and costs may not accrue or be collected until the association has followed §55-3206 and the member has failed to address the violation in good faith; a court may decide whether they are reasonable.

    Idaho Code §55-3206(3), (4)

Assessments, late fees and liens in Idaho

  • On written request, the association must give a member a free statement of the member's assessment account within 5 business days, and is bound by it. It must give an updated financial disclosure within 10 business days after a request, and a reconciled year-end disclosure within 60 days after the fiscal year closes.

    Idaho Code §55-3205(1), (3), (4)

Meetings and votes in Idaho

  • Board meetings must be open to members and to a representative a member designates in writing. The board may go into executive session by majority vote only for listed reasons, including legal advice from an attorney, ongoing or potential litigation, and sensitive matters about an individual member's property or assessments, such as violations. Minutes must be taken of all association meetings and kept at least 10 years.

    Idaho Code §55-3204(1), (2), (3)(c)

  • Every association holds a membership meeting each calendar year. Notice of member meetings is fair and reasonable if given no fewer than 10 days (30 days if mailed other than first class or registered mail) and no more than 60 days before the meeting.

    Idaho Code §55-3204(3)(a), (b); §30-30-505(3)

Records in Idaho

  • Members may inspect and copy core records on written notice at least 15 business days before the inspection date; accounting records, minutes excerpts and the membership list need a good-faith, proper-purpose request described with reasonable particularity. Copy fees can't exceed the estimated cost of production.

    Idaho Code §§30-30-1102, 30-30-1103(3)

Flags, signs, solar and other owner rights

  • An association may not prohibit political signs (fixed, ground-mounted displays for or against a candidate or ballot measure) but may adopt reasonable rules on time, size, place, number and manner. It may remove one without liability if it is on common or association property, threatens public health or safety, violates a law or ordinance, or has sound, music or other materials attached. Otherwise it may not remove a political sign from a member's property or impose any fine or penalty without first giving the member 3 days' written notice that identifies the rule and the nature of the violation; a fine also needs the §55-3206 process.

    Idaho Code §55-3209

  • An association may not prohibit rooftop solar panels (it may set placement if south-facing or within 45 degrees east or west of due south is allowed); may not add, amend or enforce a covenant limiting rentals, or accessory dwelling units, unless the affected owner expressly agreed in writing; and since July 1, 2024 may not add, amend or enforce a covenant that prohibits a family daycare home (covenants in effect before then aren't affected). Idaho sets no architectural-review deadline or deemed-approval rule; your documents control.

    Idaho Code §§55-3208, 55-3211, 55-3212, 55-3213

  • An association may not prohibit display of the U.S. flag, the Idaho flag, the POW/MIA flag, or an official or replica flag of a branch of the U.S. armed forces. It may adopt reasonable flag rules but must allow at least one flagpole per property, no more than 20 feet tall, in the front yard or attached to a part of the home the member owns and the association doesn't maintain. It may not remove a protected flag or impose any fine or penalty without first giving 3 days' written notice that identifies the rule and the nature of the violation.

    Idaho Code §55-3210

Other rules boards should know

  • A board may not use its power to adopt rules for the common property to expand the restrictive covenants as they relate to a member's property. If an association violates the Act and a member prevails in a legal action to protect the member's rights, the member gets reasonable attorney's fees.

    Idaho Code §55-3204(5), (8)
